Donald Trump was intensifying his election campaign for the election of the US President, but in the meantime he has suffered a big setback. Now he will not be able to contest the 2024 elections. Actually, Trump has been disqualified by the Colorado Supreme Court in the Capitol Hill riot case. This matter is of 6 January 2021. However, he still has time till January 4 to appeal, from where he can get relief.
The Court has held that the US Constitution bars the front-runner for the next Republican nomination from running for office because of his role in inciting violence against the US government.
It is reported that the State Supreme Court’s decision applies only to Colorado, but the historic decision will affect the 2024 presidential campaign. Colorado elections officials have said the case needs to be settled by Jan. 5, the statutory deadline to determine the slate of candidates for the March 5 GOP primary.
The court says that while President, Trump not only instigated the attack, even when Capitol Hill was under siege, he repeatedly said that Vice President (Mike) Pence should refuse to perform his constitutional duty. At the same time, senators were called and asked to stop the counting of electoral votes. Trump has been involved in the Capitol Hill attack.
Court rejects Trump’s free speech claims
Apart from this, the court rejected Trump’s claims of free speech. Also said that Trump’s speech on January 6 was not protected by the First Amendment. In fact, the 14th Amendment, ratified after the Civil War, states that officers who take an oath to support the Constitution are banned from serving in the future if they join the rebellion. However, it does not explicitly mention the term of the presidency and has been invoked only twice since 1919.
