The CCI had accused the company of this privacy policy of WhatsApp. CCI said that WhatsApp is taking advantage of its market dominance and pressurizing users to approve the new privacy policy. After this, in July last year, WhatsApp had assured the Delhi High Court that the company would not force users to accept the new privacy policy.
CCI started investigation last year
Even if an old user does not accept the new privacy policy of the company, their features will not be downgraded. In March last year, the CCI had set up an inquiry on WhatsApp’s new privacy policy. But WhatsApp has not yet given the documents related to the new privacy policy to the CCI and has not responded to it. CCI believes that this investigation of WhatsApp has nothing to do with data privacy. The commission is only looking to ascertain whether the instant messaging platform has misused its market dominance in India or whether the company has pressured users to approve the new privacy policy.
The CCI had sent three notices to WhatsApp before this investigation. Two notices were sent in March last year. Whereas a notice was sent in June last year. After this the instant messaging platform had approached the Delhi High Court against it. This case is still pending in the High Court. The messaging company has not got a stay from the High Court to stop this investigation. According to the website of the Delhi High Court, in July last year, WhatsApp was asked to respond to the court notice and submit its opinion, which was later extended to August 27, 2021.
After this, the court has given four more extensions to respond to the instant messaging company. The company has now got a new deadline till July 21, 2022 to present its side. It is also believed that the messaging service provider company of Meta has shifted most of the users on a voluntary basis under the new privacy policy. It is also being said that the company will not express its opinion on this until the data policy is implemented by the Parliament.
