The Supreme Court, while giving an important verdict on Thursday, has clarified that if the road accident has happened due to the negligence of a driver, then there is no responsibility to compensate the insurance companies. The court said that when an accident occurs due to the accident of the driver, his family cannot get any benefit under insurance.
This decision was pronounced by the bench of Justice PS Narasimha and Justice R. Mahadevan. He dismissed a petition seeking compensation of ₹ 80 lakh. This petition was filed by the wife, son and parents of NS Ravisha. Ravisha died in a road accident, when he lost control while driving at a high speed.
Karnataka High Court also gave decision
The Supreme Court upheld the Karnataka High Court's decision of 23 November 2023, already rejected the demand for compensation. The Supreme Court said, “We are not keen to interfere in the High Court's decision. Therefore, this special permission is dismissed.”
The accident took place 11 years ago
The accident took place on 18 June 2014, when Ravisha was going from Mallasandra village in Karnataka towards Arsikare Town. He was accompanied by his father, sister and his children. Investigation revealed that Ravisha was driving carelessly. Did not follow the traffic rules and lost control of the vehicle. Due to which the car overturned. He died in this accident.
Driver's fault proved
The Karnataka High Court had already admitted that the accident happened due to the driver's own mistake and he himself was going to harm his life. Therefore, his family cannot be legally compensated. The court also said that compensation in such cases will be like rewarding the person's own mistake, which is against the principles of justice.
Drivers will have to take lessons
