What is more interesting is that even after these formulas are not legally recognized in our courts, the investigative agencies of India make frequent use of these infallible prescriptions recorded in the books of forensic science.
There are many such surprising formulas in forensic science, which prove to be a panacea in the investigation of any criminal incident, in getting the suspect accused guilty. Even if these formulas have proved to be very useful in getting top or first class results in investigation. The use of these formulas in foreign countries may have solved the complicated mystery of all criminal cases by the police and investigative agencies. Even after this, not all of these extremely useful formulas have been recognized in Indian courts. What is even more interesting is that even after these formulas are not legally recognized in our courts, the investigative agencies of India make frequent use of these infallible prescriptions recorded in the books of forensic science. Even if the results obtained from these prescriptions are not put before the court during the trial of criminal case by Indian investigative agencies as legal evidence. Yes, it is necessary that with the use of these amazing and very useful forensic science formulas, the investigating agency reaches the real culprit out of the crowd of all the suspects.
When it is mentioned that as in foreign countries, Indian courts do not have legal recognition for such and such successful formulations of forensic science. Therefore, it is necessary to mention the fact that forensic science formulas or their results have been legally recognized in Indian courts when they are filed or presented by the investigating agencies. The list of such forensic science formulas and legal evidence includes DNA, CCTV footage, mobile clips, mobile call record data, finger prints etc. Yes, all these will also be valid as evidence in Indian courts only when the investigating agency files an affidavit in writing in the court under Section-65B of the Indian Evidence Act. Especially in the case of electronics evidence. This fact is also corroborated by senior criminal lawyer of Delhi High Court and retired DCP of Delhi Police Special Cell, LN Rao. Let us now talk about the panacea-proof formulas of forensic science, which prove to be helpful in bringing the investigating agencies to the real culprits. These formulas have also been recognized as legal evidence in all other countries of the world including America. But they have not got legal recognition in Indian courts yet.
Even after this, the Indian Police and other investigative agencies openly use these amazing forensic science tips and reach the real culprit. In the end but when it comes to presenting these evidences in the courts, Indian agencies do not present the evidence of all these works as evidence during the trial of the case before the court, because the Indian knows the investigating agencies or the investigation of the criminal incident. That all these evidences kept by him in the court will not be legally valid. Then why should the investigating agencies or investigating officers waste their time and the time of the court unnecessarily? Let us now mention the forensic science formulas of such work, which are of great use, but their legal value is zero in Indian courts. These are hypnosis or hypnotic analysis, tendal impressions (marks of teeth bitten by a human being present on the body), lie detection, narco analysis, brain mapping and psycho analysis etc. India’s famous forensic science expert Dr. KL Sharma has his own unequivocal opinion regarding all these facts. According to him, the report or opinion of forensic science experts is sometimes cut in Indian courts. The evidence of forensic science cannot be cut legally but in court.
Dr. KL Sharma, who has worked as a forensic science expert in Delhi, the capital of India for nearly 40 years, says that as far as hypnosis or hypnotic analysis by Hindustani forensic science experts, investigating agencies, investigating officers, tendal impressions (by any person present on the dead body) If we have used the marks of his teeth bitten from the mouth), lie detection, narco analysis, brain mapping etc., then they are used a lot here (in India). In my 40-year job as a forensic science expert, I also used these formulas to solve all the complicated mysteries of criminal cases. It is a different matter that all these successful formulas have not been legally recognized in Indian courts till date. If legal recognition is given, then the proportion or graph of punishment in our country can increase much more. As evidence Dr. Sharma mentions one such case resolved by himself. The case that the police, involved in solving the matter, had taken a fatal step like getting an innocent person accused of being accused. Forensic science expert (Dr. KL Sharma) but in that case also used astonishing formula of forensic science completely invalid in Indian courts like hypnotic analysis.
Dr. KL Sharma says that in the early 2000s, an investigating officer of the Delhi Police was bent on accusing a 70-75-year-old man as a murderer for the murder of an old man who was sleeping on the pavement. In that case, according to the calculations of forensic science, when another suspected youth got his hypnotic analysis test done by a private hypnotic expert, then the whole matter was turned upside down. With the help of a hypnotic analysis test, the suspected youth was declared a murderer while an innocent old man was saved from the charge of murder. It is interesting that this was the same successful hypnotic analysis formula of the world of forensic science, which has been recognized as evidence in foreign courts. Hypnotic analysis is still not legally valid in Indian courts. Why only a hypnotic analysis As far as I know, psycho analysis is not legally valid in Indian courts yet, while that too in the world of forensic science, the surefire formula to get the real accused convicted from among the multitude of accused and suspects is.
