Lakhimpur Kheri case accused Ashish Mishra has been granted interim bail with conditions by the Supreme Court. The court has said that at present Ashish is being released for 8 weeks. But the bail can be canceled on violation of the conditions. Ashish will have to leave Uttar Pradesh within a week of his release. He cannot even live in Delhi at the moment.
The court has also said that it will hear the matter again on March 14. On that day the order given today will be reviewed. Along with this, the Supreme Court has also ordered the release of 4 farmers accused of murder on interim bail.
What is the matter?
On October 3, 2021, in Lakhimpur Kheri, Uttar Pradesh, there was an incident of driving a vehicle over the agitating farmers. A total of 8 people lost their lives in this incident and in the subsequent beating of the accused by the fierce farmers. The main accused in the case is Ashish Mishra alias Monu, son of Union Minister of State for Home Affairs Ajay Mishra Teni. On February 10, 2022, the Allahabad High Court ordered Ashish to be released on bail. On 18 April, the Supreme Court quashed that order. Since then he is in jail. Now the Supreme Court has ordered his release with conditions.
‘Argument placed on behalf of Ashish’
It was argued on behalf of Ashish Mishra that he has spent more than 1 year in jail, while there is no concrete evidence of his involvement in the incident. In the report sent to the Supreme Court, the judge of the lower court of Lakhimpur Kheri had told that it may take up to 5 years to settle the case. On this, the court indicated bail to Ashish and said that no one can be kept in jail till the trial is over.
The complainant had protested
Senior advocate Dushyant Dave, appearing for the complainant farmer in the case, strongly opposed the grant of bail to Ashish. He had said that Ashish’s family is very influential. He can influence the trial. During the hearing, the Supreme Court had also said that it is also concerned about the 4 farmers arrested in connection with the violence after the incident and wants them to be granted interim bail.
Justices Surya Kant and J.K. Maheshwari’s bench has said in its decision that personal liberty is the right of every citizen. It is not right to keep someone in jail on the basis of pending trial. But at the same time, the judges have also accepted that the apprehensions expressed by the complainant side also seem to be correct in their place. In such a situation, while granting interim bail to Ashish for 8 weeks, the court has imposed several conditions.
