Bulldozers will not work on more than 4,000 houses of Banbhulpura situated on railway land in Haldwani. The Supreme Court has extended the ban on the demolition of this settlement for 8 weeks. The Supreme Court on Tuesday heard against the order of the Uttarakhand High Court, in which it was asked to remove the encroachers from the land claimed by the Railways. The Uttarakhand government and the Railways presented their stand in front of the Supreme Court bench comprising Justice SK Kaul and Justice Manoj Mishra.
The state government and the Railways sought time from the Supreme Court to find a solution to this dispute. After this, the Supreme Court extended the ban on removal of encroachments for 8 weeks.
The next hearing in this case will now be on May 2. Earlier on January 5, this matter was placed before the Supreme Court through a public interest litigation. At that time, the Supreme Court had stayed the implementation of the decision of the Uttarakhand High Court.
4,365 houses, shops, temples and mosques have been considered as encroachments
Banbhulpura colony is situated on about 29 acres of land adjacent to the railway line in Haldwani. 4,365 houses, shops, temples, mosques of this settlement were issued a notice to remove the encroachment on the railway land. According to the notice issued by the Railways, this encroachment was to be removed by January 9. This notice to remove possession was given under the order of the Uttarakhand High Court. A public interest litigation was filed in the Supreme Court against this action, which deprived about 50,000 people of their homes and shops. After this, the Supreme Court had stayed the order of the Uttarakhand High Court.
The township is already inhabited even before independence
Apart from Banbhulpura, this area situated in an area of more than 2.2 kilometers is also known by the names of Gafoor Basti, Dholak Basti and Indira Nagar. The people living here claim that their families have been settled here even before independence. More than half of the people are also claiming to have land pattas documents with them.
