Labor laws in the country (Labor LawsTo give a new look to the government, four new labor codes (Labor Codes) have been issued. This new code has everything that companies and their employees need. For example, issues like salary, pension, gratuity and PF like social security, labor welfare, health and working conditions have been seriously considered. Keeping all these issues in mind, four new labor codes have been created. Women can work with full safety in offices or factories, this has also been taken care of in the Labor Code. The most important thing is that in the Labor Code, special rules have been set for working hours and holidays. This means that when labor codes are implemented, there will be a big change in working hours. Along with this, there will be a new change in the timing of holidays.
At present, the holidays and working hours of central employees are determined under the Factories Act, 1948. Shops and Establishment Act has been made for the states. That is, the leave and working hours of the employees of the states are decided by this law. Now the government wants to decide the holidays and working hours at every level with the new labor code. The new labor codes will be applicable to all types of industries. However, there will be an exemption for the states that they will be able to fix working hours and holidays under the Shops and Establishment Act as before. However, there will be no complete arbitrariness of the state governments in this and they will have to take good care of the new labor code of the center.
how many hours will work
Under the new labor code, the daily and weekly working hours have been capped at 12 hours and 48 hours respectively. That is, no employee can work for more than 12 hours in a day and 48 hours in a week. Nor can companies take more work than this. In view of these hours of work, the provision of ‘4-day work week’ has been brought. This means 4 days of work and 3 days of rest in a week. Assuming maximum 12 hours in a day, then the rule of 48 hours is fulfilled in 4 days. For the remaining three days, the employee can rest, spend holidays.
Along with the working hours of every day, maximum overtime hours have also been prescribed. Earlier its limit was kept at 50 hours, which has been increased to 125 hours. This is for one quarter ie 7 days. This will give relief to the companies as they can get work done 4 days a week and can take work from other workers on weekends. 4 days work is being considered as a double edged sword as it will give more rest to the employees, but on the other hand 12 hours of work will have to be done in a day. Its effect can be seen on health.
what will be the rules of holidays
In the new labor code, major changes have been made in the rules of holidays. Now the required condition has been reduced from 240 days to 180 days. This means that at present, a new employee can apply for leave only after doing 240 days of duty. In the new labor code, this period has been reduced to 180 days. If a new employee does 180 days of duty, then he will be entitled to apply for leave. However, the rule of ‘leave earned’ (earning from leave) has been kept as it is. One earned leave will be available for every 20 days of duty. There has also been no change in the carry forward limit of leave. In the new labor code, the rule of cashing the leave has been made mandatory for every sector.
Let us take an example to understand the rule of carry forward. Suppose at the end of the year an employee has 45 days of holidays left. In such a situation, the company will give 15 days leave money to that employee and 30 days leave will be carried forward to the next year.
