According to the Death Penalty Research Project of the National Law University in this article, it has been told that since the independence of the country, more than five thousand people have been sentenced to death. But, very few of these people have been given the death penalty. That is, due to many legal processes, many convicts have not been hanged yet. Let us tell you that so far only 1414 people have been hanged.
When was the first hanging?
According to the article, the first execution in the country was given on 9 September 1947 in Jabalpur Central Jail. The last hanging was given to the 4 convicts of the Nirbhaya case on 20 March 2020 in Tihar Jail. According to the NCRB, 442 prisoners had been sentenced to death till December 2020 in the country, out of which 29 were commuted to life imprisonment by the court, 413 prisoners were yet to be executed.
At the same time, if we talk about the year 2021, then 144 people were sentenced to death. In such a situation, till December 2021, there were 557 such prisoners in jails, who were not hanged even after being sentenced to death.
Why can’t it be implemented?
There are many reasons behind not being hanged after sentencing. Actually, what happens is that when the lower courts give the death sentence, it is confirmed by the High Court. In such a situation, many times the High Court changes the sentence and then it is challenged in the Supreme Court. After this, there are options like reconsideration, curative petition, mercy petition with the President, as a long time passes. Due to many technical reasons this is not possible.
