In most of the cases, the employees get this amount in their accounts without any hassle after leaving the company, but there have also been cases where the employees had to make efforts to get the gratuity amount.
What if the company is reluctant
Gratuity takes some time to arrive. In such a situation, before leaving the company, find out how long it will take. However, with the advancement of technology, this work has become very fast. If you do not get the gratuity money even after the time has passed, inform your company about it and ask to know the reason for the delay and to speed up the process. If their answer is not satisfying you or is negative, then first send a legal notice to your company. If you have not received the money even after sending the notice, then file a complaint against the company in the Labor Commissioner’s Office of your district. Keep in mind that the Payment of Gratuity Act 1972 entitles employees to receive gratuity. It is clear that if you have fulfilled the rules then no one can stop you from getting gratuity. On your complaint, the office will issue payment instructions to the company.
The company will have to release the amount of gratuity within 30 days of issuing the instructions. If even then the company does not release the money, legal action will be initiated against it. If the complaint against the company is found true, then the responsible person of the company can be jailed for 6 months to 2 years.
