The amount of the fine will be decided on the basis of the number of affected users. Under the rules given in the bill, companies can appeal against the fine in the court. Companies will have to keep data in government-approved countries. After it becomes law, companies will not be able to keep data in China.
Under the Bill, personal data breach of an individual would mean unauthorized data processing. Action will also be taken if a person’s personal data is tampered with or damaged. Apart from this, if there is any kind of compromise with the privacy of the person through the data, then also the government will take action.
The bill may be introduced in the next session of Parliament
By releasing the draft, the government will now take the opinion of all the parties. Opinion can be sent on the draft of the bill till 17th December. The draft of the bill has been uploaded on the website of the IT Ministry. This draft can be presented in the next session of Parliament. Through this, the objective of the government is to protect the personal data of the person, keep an eye on the transfer of data outside India and make provision for penalty for any kind of data violation. Earlier, the government had withdrawn the Personal Data Protection Bill. The Union IT minister had said in September that the government would come out with a new draft of the Data Protection Bill in the next few days.
The government will bring this new law regarding the protection of data on the lines of the European Union. The government is serious about the misuse of personal data of customers. After the coming of this law, the companies using the data without the permission of the customers will have to steal a huge cost.
