Male teachers appointed in primary and upper primary schools of Uttar Pradesh have got a big relief from the Allahabad High Court. The court has said that if the teacher couple is posted in different districts, then the male teacher will get a chance for inter-district transfer. The thing to note here is that the male teacher does not even need to follow the rules made to take advantage of this rule. currently as long as a teachers Does not complete the tenure of 5 years in a district, till then he cannot be transferred.
Hearing a petition, the court said that the husband would be given an inter-state transfer only if the teacher couple is a teacher in a council school. For this, there is no compulsion to complete the tenure of five years. Sanjay Singh and eight other teachers approached the Allahabad High Court in this regard. These people had demanded that husband and wife should be appointed in the same district. While hearing this petition, the court ordered the Basic Education Officer in this regard.
The High Court said that the Director Basic Education should take a fresh decision on the representation given by these teachers within a month. At the same time, the demand for interstate transfer of these teachers was canceled by the director. Now the court has also canceled the order of the director in this regard. Justice Ashutosh Srivastava heard this petition.
What was said in the petition?
It was said in the petition that all the petitioners are working as teachers in different districts of UP. The wives of all these people are also teachers, but they have been appointed in different districts. There was a demand of all these people that they should be transferred to the district of their wives as well. The High Court had heard this matter on October 5, 2021.
During this, the court had said that under normal circumstances, it is mandatory to teach five years in a district for inter-district transfer. But in special circumstances this rule can be exempted. The court asked the Director Basic Education to take a decision on the demand of the petitioners for this reason. But the director canceled the demand. He said that it has not been five years since the appointment of these teachers.
At the same time, the petitioners approached the High Court regarding their demand. He said that the director rejected his demand without taking into account the special circumstances. On the other hand, now the court has made it clear that the director’s decision is overruled and special circumstances will be taken into account for the transfer.
