The counsel appearing for the Central Government replied that Agniveer is a separate cadre from the regular cadre of the Armed Forces. On this, the Delhi High Court said, ‘The nature of the job from a different cadre does not answer. The question is of work and responsibility.
Agniveer cadre is different from regular cadre
A bench of Chief Justice Satish Chandra Sharma and Justice Subramaniam Prasad told Additional Solicitor General (ASG) Aishwarya Bhati, appearing for the Centre, “If the nature of the job is the same, how can you justify different pay scales?” A lot will depend on the nature of the job. Get instructions on this and include it in the affidavit.
The ASG replied that ‘Agniveer cadre is different from regular cadre. Therefore their terms, conditions and responsibilities are also different from the soldiers. The responsibility cannot be the same. Even the work of Agniveers and general cadre is not the same. Agniveer cadre has been made as a separate cadre. It will not be counted as regular service. Regular cadre service starts when found fit after serving as Agniveer for four years.
For the first time, young girls are being inducted in the armed forces as Agniveers. When the counsel for one of the petitioners said that this was being done without medical examination, the bench said, “Don’t you think you should welcome this move?” Girls are also coming in this, it is a welcome step.
Agniveer just below the officers
Defending the Agneepath scheme, the Center said that a big study was done for this policy. This was not a decision that was taken lightly and the Government of India was aware and conscious of the situation. The Center further said that below the rank of officers, now Agniveer is the only way to join the armed forces at the level of soldiers and only the medical section has been kept out of it.
The ASG said that ‘Indian Armed Forces are the most professional armed forces in the world. He should be given more leeway when he is taking such big policy decisions. During the last two years, several internal and external consultations were held, several meetings were held with the stakeholders.
The hearing in the Delhi High Court on the petitions challenging the Agneepath scheme for army recruitment will continue today, Thursday, December 15, 2022.
