Government’s big decision regarding GST (indicative picture)
Actually, taxpayers show the supply invoice in GSTR-1 but they do not file GSTR-3B return, whereas tax is paid to the government from this form. This is an attempt to save tax.
If you want to claim GST refund then you have to get your Aadhaar verified. The government has made this rule mandatory. This means that people whose Aadhaar is not verified, they will not be able to get the refund of GST.
The Central Board of Indirect Taxes and Customs (CBIC) has amended the GST rules. This amendment has been made to prevent tax evasion under GST. Now GST refund will be given only in the bank account. GST refund will be sent on the PAN with which the GST registration will be done and the bank account linked to it.
Who can file GSTR-1
In the notification related to this, it has been said that on January 1, 2022, businesses who default in filing summary return, will not pay GST every month, they will not be able to file GSTR-1 for the next month. This notification was taken after the meeting of the GST Council which was held in Lucknow on September 17. The decision related to Aadhaar verification was also considered in the same meeting.
Rajan Mohan, Senior Partner, AMRG & Associates, told PTI, “To prevent tax evasion, the government has made Aadhaar verification mandatory for proprietors, partners, kartas, managing directors, whole-time directors and authorized signatories. Aadhaar verification has been made mandatory for filing refund applications for GST or eliminating the cancellation of registration.
Abhishek Jain of EY Tax Partner says that to prevent evasion of government revenue, the government has made Aadhaar verification mandatory for taxpayers. Now through this verification, taxpayers will be able to claim GST. Jain says that this step will stop the fraud refund of GST because only those taxpayers whose Aadhaar is verified, they will be given GST refund.
Why did the government take this step
If a taxpayer does not file GSTR-3B for the previous month, then he will not be able to file GSTR-1. Regarding this, Abhishek Jain says that this ban has been imposed with a lot of thought because it will stop those cases in which GST is filed by giving fake information. Now those who have filled the GSTR-3B of the previous month, they will be able to fill the GSTR-1 form of the next month. At present, if the registered person does not file return in Form GSTR-3B for the last two months, then he is not allowed to submit GSTR-1.
